The U.S. Supreme Court will review a patent infringement case against eBay, granting the online auctioneer's petition on Monday. The matter under review is whether to allow MercExchange, the plaintiff in the case, to obtain a permanent injunction against eBay related to the way it handles fixed-price sales. A district court in 2003 found that eBay's "Buy It Now" feature infringed on two MercExchange patents. Buy It Now allows consumers to purchase an item without participating in an aucti...

Supreme Court Actually Interested In Patent-Related Injunctions eBay has been in a long struggle with a company called MercExchange, the history of which we've gone over before . Basically, this company MercExchange managed to patent the concept of online auctions as well as the concept of offering a fixed price "buy it now" option. They sued eBay and won. While the online auction patent was later tossed out, the "buy it now" patent has stood (though, many of the patents involv...

Untitled Document Driving While Stupid: Text Messaging Teen Kills Cyclist It's likely that we'll be hearing a lot more stories like this one over the next few years, but a teenager who was apparently text-messaging while driving stuck and killed a cyclist last week. This is likely to bring about calls for laws outlawing text messaging while driving, which is sort of missing the point. Doing anything that puts others in the road while driving is already illegal as reckle...

I'm forever downloading demos and trial version software every week in an afford to find the right tool for the job at hand. As you know I'm a college student and money is the one commodity I lack. Trial versions and demos give me the chance to use for free the program before concluding if it's the right tool for me. This routine has left my pc filled with old pieces of software hidden on my hard drive gathering dust. This is my own fault and is down to bad housekeeping on my part. I...

Robert Scoble a noted blogger has blogged numerous articles on many subjects but the most interesting of all is how he is honest and open about the inner workings of Microsoft. Scoble's observations of Microsoft point to a crumbling silicone wall of secrets where only the inner microsoft family gossip. Microsoft has been for me and many other students at Tipperary Institute a superpower giant standing on our ideas. We the student body rely on microsoft software to provide the tool of our ...

Validating the html and other codes in your website can be a time consuming task. Because validation simply checks the mark up language for proper syntax, I have wondered if using this process will benefit a site when it comes to search engine rankings, and as such, is it worth doing? There are a number of sites that offer validation tools, but the one I use resides on the W3C web site. The process of validation is simple enough. You simply enter the URL of the site in question or W3C allows...

College blues as I'm back to study again after three months. The first thing I noticed was how the students returning for their second and third year of studies entered the doors of teaching with smiles. College is not just study and learning but for some a second family. Many of my fellow students are to return and share their three months of adventure, from travel to summer jobs of interest. The gossip and stories ease us into the first few classes. I'm glad to be back as it gives me...

Last Wednesday myself and two others set off to Dublin at the early hour of 4.30 just to get an interview for our new radio station Lash FM. We arrived in Dublin at 6.55 to find the car parks closed untill 7am. A first for me soon after parking we set across to the Eason bookstore wher we were greeted with a line of people from one end of the block all the way around the corner. A total of 1500 signings were written that day. It's no wonder when I finally got to meet the former leader of the ...
